Investigations in the #MeTooEra



The #MeToo movement started as a social media campaign in the wake of the Harvey Weinstein scandal. The movement has increased awareness of workplace sexual harassment, but it has also sparked a backlash as critics claim that accusers are treated unfairly, that the accused are denied due process and that minor infractions are blown out of proportion. Conducting harassment investigations in the wake of #MeToo poses unique challenges for human resources professionals.

This interactive program will show how to conduct an impartial and effective harassment investigation in a thorny “he said/she said” scenario.

Attorney Vicki L. Sproat is the founding partner of Sproat Workplace Investigations, an employment law firm that conducts and manages investigations of complex and sensitive disputes for large and small employers in both the public and private sector. Vicki spent 38 years at the Fort Myers-based law firm of Henderson, Franklin, Starnes & Holt, P.A. as a trial attorney and employment law counselor. As a part of her practice, she conducted many high-profile investigations for both public and private employers. She is one of a small number of Florida lawyers to achieve dual Board certification by the Florida Bar (Civil Trial Law since 1991 and Labor and Employment from 2012-2017). She is an Association of Workplace

Investigators Certificate Holder (AWI-CH) after completing a series of assessments at the organization’s training institute in Santa Barbara, California, signifying that she has mastered the core knowledge and skills necessary to effectively perform impartial workplace investigations. Vicki was honored as Trial Lawyer of the Year by the Southwest Florida Chapter of the American Board of Trial Advocates for her distinguished career and superb reputation for high ethics and fair play. Vicki is a long-time member of SHRM, having served on the Board of Directors for the Southwest Florida chapter.

At her new firm, Vicki conducts workplace investigations, investigation consulting, investigation training and offers courtroom testimony. The firm’s website, features a section of frequently asked questions and news on workplace issues designed to help employers understand the legal challenges they face and the action needed to meet those challenges.
